PUTUSAN ULTRA PETITUM PARTIUM PERKARA PERDATA DITINJAU DARI PASAL 178 AYAT (3) HIR (Studi Kasus Putusan Nomor 445/Pdt.G/2018/PA. Kab. Mn)

Abstract
Civil procedural law recognizes the principle of Ultra petitum partium as referred to in article 178 paragraph (3) of the HIR which states that "a judge is not allowed to make a decision on a case that is not being charged, or to give more than what is required". In fact what happened at the Madiun Regency Religious Court with Decision No. 4.45/Pdt.G/2018/PA.Kab.Mn, the panel of judges gave more than what was requested by the plaintiff of the reconciliation where the plaintiff only asked for a child's support of Rp. 1,500,000 each month until the two children were adults, but the judge granted the child's support of Rp. 1,500,000 plus 10% per year. This is supported by the Supreme Court Decision Number 556 K / Sip 1971 where the decidendi ratio of the judges in the Supreme Court Decision said that "to grant more than the accused is permitted, as long as this is still in accordance with the material incident". So that in this study a problem formula can be drawn: 1) Is the judge in deciding civil case No. 4.45/Pdt. G/2018/PA.Kab. Mn that exceeds petitum (ultra petitum partium) has violated Article 178 Paragraph (3) of the HIR? 2) What is the decidendi ratio of the civil case decision No. 4.45/Pdt. G/2018/PA.Kab.Mn that exceeds petitum (ultra petitum partium)? Then the method used in this research is document or literature study research aimed at or carried out only on legal materials in the form of written regulations or other legal materials.

Abstrak
Hukum acara perdata mengenal asas Ultra petitum partium sebagaimana dimaksud dalam pasal 178 ayat (3) HIR yang menyatakan bahwa “seorang hakim tidak diizinkan untuk menjatuhkan keputusan atas perkara yang tidak dituntut, atau memberikan lebih daripada yang dituntut”. Pada Kenyataannya telah terjadi di Pengadilan Agama Kabupaten Madiun dengan Putusan No 4.45/Pdt.G/2018/PA.Kab.Mn majelis hakim menjatuhkan melebihi dari apa yang diminta oleh penggugat rekonvensi dimana penggugat hanya menginginkan nafkah anak sebesar Rp 1.500.000 setiap bulanya hingga kedua anaknya dewasa, namun hakim mengabulkan nafkah anak sebesar Rp 1.500.000 ditambah 10% pertahunnya. Hal tersebut didukung oleh Putusan MA Nomor 556 K/Sip 1971 dimana ratio decidendi dari hakim pada Putusan MA tersebut mengatakan bahwa “mengabulkan lebih dari yang digugat adalah diizinkan, selama hal ini masih sesuai dengan kejadian materiil”. sehingga dalam penelitian ini dapat ditarik suatu rumusan masalah 1) Apakah hakim dalam menjatuhkan putusan perkara perdata No. 4.45/Pdt. G/2018/PA.Kab. Mn yang melebihi petitum (ultra petitum partium) telah melanggar Pasal 178 Ayat (3) HIR? 2) Apa ratio decidendi dari putusan perkara perdata No. 4.45/Pdt. G/2018/PA.Kab.Mn yang melebihi petitum (ultra petitum partium)? Kemudian metode yang digunakan dalam penelitian ini adalah penelitian studi dokumen atau kepustakaan yang ditujukan atau dilakukan hanya pada bahan hukum berupa peraturan-peraturan yang tertulis atau bahan hukum yang lain.
