KEKUATAN MENGIKAT HUKUM DALAM PERSPEKTIF MAZHAB HUKUM ALAM DAN MAZHAB POSITIVISME HUKUM
Abstract
Terdapat perbedaan pandangan antara mazhab hukum alam dan mazhab positivisme hukum mengenai kekuatan mengikat hukum alam. Menurut mazhab hukum alam, hukum merupakan keadilan, sehingga hukum yang tidak adil bukan hukum. Karenanya, hukum hukum memiliki kekuatan mengikat apabila hukum berisi keadilan, bermoral, berisi kebenaran, dan sesuai etika. Adapun mazhab hukum alam memandang hukum sebagai perintah dari penguasa. Sehingga, hukum memiliki kekuatan mengikat karena adanya perintah.
