PENEGAKAN HUKUM YANG BERKEADILAN ATAS FENOMENA IDENTITAS GANDA WARGANEGARA INDONESIA DI PERBATASAN INDONESIA-MALAYSIA
Abstract
Abstract
The main problem in this research is the enforcement of the dual identity law of Indonesian citizens in the border area. This study uses a normative juridical method, namely research that uses the norms in the 1945 Constitution and other laws and regulations related to the object of research. This research is a follow up from the results of previous research with the title of the legality of the Temporary Residence Certificate (SKTS) by the Immigration Unit at the Indonesian Cross-border Post. Especially in the Cross Border Post in Nunukan Regency, North Borneo. The results of this study conclude that the problem of law enforcement can be implemented with a justice approach for citizens and States. John Ralws 'principle of justice in the approach of border citizens' welfare. Completion of this law is able to provide an educational role for citizens and ensure the continuity of state rights in guaranteeing and protecting Indonesian citizens in the border areas of the Unitary State of the Republic Indonesia.

Abstrak
Masalah utama dalam penelitian ini adalah penegakan hukum identitas ganda warganegara Indonesia di daerah perbatasan. Pendekatan dalam penelitian ini menggunakan metode yuridis normatif, yaitu penelitian yang menggunakan norma-norma dalam UUD 1945 dan peraturan perundang-undangan lainnya yang terkait dengan objek penelitian. Penelitian ini merupakan tindak lanjut dari hasil penelitian sebelumnya dengan judul legalitas Surat Keterangan Tinggal Sementara (SKTS) oleh Unit Imigrasi di Pos Lintas Batas Indonesia. Terutama di Pos Lintas Batas di Kabupaten Nunukan, Kalimantan Utara. Hasil penelitian ini menyimpulkan bahwa masalah penegakan hukum dapat diimplementasikan dengan pendekatan keadilan bagi warganegara dan Negara. Prinsip keadilan John Ralws dalam pendekatan kesejahteraan warganegara perbatasan. Penyempurnaan undang-undang ini mampu memberikan peran pendidikan bagi warganegara dan memastikan kelangsungan hak-hak Negara dalam menjamin dan melindungi warganegara Indonesia di wilayah perbatasan Negara Kesatuan Republik Indonesia.
