PERBUATAN TERCELA SEBAGAI ALASAN PEMAKZULAN PRESIDEN DAN/ATAU WAKIL PRESIDEN

Dari enam alasan Pemakzulan Presiden dan/atau Wapres dalam Pasal 7 UUD 1945, yaitu (1) pengkhianatan terhadap negara, (2) korupsi, (3) penyuapan, (4) tindak pidana berat lainnya; (5) perbuatan tercela; dan (6) tidak lagi memenuhi syarat sebagai Presiden dan/atau Wapres, terdapat satu alasan yang perumusan normanya bersifat abstrak dan kabur, berakibat dapat ditafsirkan secara beragam (multitafsir), yaitu melakukan “perbuatan tercelaâ€. Perumusan norma demikian bertentangan dengan dengan prinsip negara hukum demokratis yang bertumpu pada asas legalitas dan kepastian hukum dan asas pembentukan peraturan perundangan yang baik, yaitu asas kejelasan dan kelengkapan rumusan. Sehingga akan menjadi alasan bersifat elastis yang mudah “dimainkan†secara politis oleh DPR dalam
proses pemakzulan Presiden dan/atau Wapres.
