Sanksi Bagi Pengusaha Yang Melakukan Pelanggaran Dalam Masa Proses Pemutusan Hubungan Kerja (PHK)
Abstract
Sanksi adalah suatu penderitaan yang diberikanKkepada seseorang yang telahKmelakukan suatuOperbuatan pelanggaran mauapun kesalahan. Pada prinsipnya dalam bidang ketenagakerjaan sanksi akan diberikan kepada para pihak yakni pihak pengusaha maupun pihak pekerja yang tidak melaksankan aturan-aturang ketenagakerjaan yang mana memuat terkait hak serta kewajiban para pihak didalamnya. Hukum ketenagakerjaan memiliki 2 jenis sanksi, yaitu sanksiLpidana dan sanksiLadministrasi. Pengaturan tersebut telah dimuat pada BAB XVI Undang-UndangLNomorL13LTahun 2003Otentang Ketenagakerjaan jo. Undang-Undang Nomor 6LTahunL2023Ltentang PenetapanLpemerintah PenggantiLUndang-Undang Nomor12 Tahun 2022LtentangLCipta Kerja MenjadiLUndang-Undang.L Berdasarkan hal tersebut, ketenagakerjaan menganutLsanksiLminimal dan sanksi minimal khusus. Perlunya penetapan sanksi untuk digunakan dalam semua tindak pidana pelanggaran yang akan memberikan dampak merugikan bagi setiap pekerja secara masif. Adanya sanksi yang dapat diterapkan dengan harapan suatu pelanggaran tidak dilakukan. Hasil dari penelitian ini, yakni mengetahui bentuk sanksi yang dapat dijatuhkan terhadap pengusaha yang melakukan pelanggaran pada masa proses Pemutusan Hubungan Kerja (PHK)
