PELANGGARAN HAK ASASI MANUSIA TERHADAP ETNIS ROHINGYA
Abstract
Hak Asasi Manusia menurut Undang-Undang No 39 Tahun 1999 merupakan seperangkat hak yang melekat pada manusia sebagai makhluk Tuhan Yang Maha Esa dan merupakan anugerah yang wajib dihormati, dijunjung tinggi dan dilindungi oleh Negara, hukum, pemerintah dan setiap orang demi kehormatan serta perlindungan harkat dan martabat manusia. Dalam hal ini banyak Hak Asasi Manusia yang dilanggar baik oleh pemerintah, aparat negara, seseorang maupun kelompok sehingga berdasarkan pengertian HAM tadi maka dapat disimpulkan bahwa pelanggaran HAM adalah setiap perbuatan seseorang atau kelompok, atau kelompok orang yang termasuk aparat negara baik disengaja maupun tidak disengaja atau kelalaian yang secara melawan hukum mengurangi, menghalangi, membatasi dan mencabut HAM seseorang atau sekelompok orang. Mengenai pelanggaran HAM yang terjadi pada Rohingya terdapat tiga pelanggaran HAM berat yaitu kejahatan terhadap kemanusiaan, genosida, perang yang dilakukan oleh Negaranya sendiri, yang dimana kasus ini telah menjadi perhatian internasional. Sebagai sesama Negara yang tergabung dalam ASEAN, Indonesia tidak tinggal diam dan Indonesia ikut berpartisipasi dalam penyelesaian kasus pelanggaran HAM yang terjadi pada etnis Rohingya. Dan PBB sebagai Organisasi Perserikatan Bangsa-Bangsa mempunyai komitmen untuk memenuhi, melindungi HAM serta menghormati kebebasan pokok manusia secara universal sesuai dalam Piagam PBB Pasal 1 ayat (3).
