KEPASTIAN HUKUM BAGI KREDITOR SEPARATIS PEMEGANG HAK TANGGUNGAN SAAT DEBITOR PAILIT
Abstract
If the court's decision states that the debtor is bankrupt, then the separatist creditors can carry out executions independently as if they were not bankrupt. The main problem is the granting of authority for separatist creditors to carry out independent execution of mortgages after passing the suspension period for a period of 90 days from the date the decision is declared bankrupt and the execution is carried out no later than 2 months after the settlement begins. (Articles 56 and 59 paragraph 1 of Law 37/2004), after 2 months have elapsed, the curator needs to sue the object as collateral to be sold in accordance with Law 37/2004. And according to that, the power of the separatist creditors to execute the mortgage objects themselves is weakened by the bankruptcy law and the PKPU, it is a conflict of norms between the mortgage law and the bankruptcy law. The protection of separatist creditors is also weakened by the existence of article 56 and article 59 of the Bankruptcy Law and PKPU, therefore it is necessary to renew the law on the execution of mortgage guarantees if the debtor is bankrupt. The type of research used in this research is normative legal research and the method of approaching this research is the legal approach. The sources and types of legal documents are divided into 3 namely primary; legislation, secondary; literature that is relevant to this study, tertiary; KBBI and black law dictionary. The technique of collecting primary legal matters is carried out using the method of inventorying and categorizing laws according to their hierarchy. The analysis technique in this study is to analyze and draw conclusions using the basis of the library teaching materials.

ABSTRAK
Bilamana putusan pengadilan menyatakan bahwa debitor telah pailit, maka kreditor separatis dapat melakukan pelaksanaan hal eksekutorial secara mandiri seolah tidak mengalami kepailitan. Pokok permasalahannya, pemberian wewenang untuk kreditor separatis melakukan eksekusi secara mandiri terhadap hak tanggungan (jaminan) setelah melewati masa penangguhan dengan kurun waktu 90 hari sejak tanggal putusan dinyatakan pailit dan pelaksanaan eksekusi selambatnya 2 bulan setelah keadaan insolvensi dimulai. (Pasal 56 dan 59 ayat 1 UU 37/2004), setelah 2 bulan terlewati, kurator perlu menggugat penyerahan benda yang menjadi agunan untuk kemudian dijual sesuai dengan UU 37/2004. Dari sini kewenangan kreditor separatis untuk mengeksekusi sendiri objek hak tanggungan dilemahkan oleh UU Kepailitan dan PKPU, terjadi sebuah benturan norma hukum antara UU Hak Tanggungan dengan UU Kepailitan dan PKPU. Perlindungan akan kreditor separatis pun melemah dengan adanya Pasal 56 dan Pasal 59 UU Kepailitan dan PKPU, sehingga perlu pembaharuan Undang-Undang terkait parate eksekusi jaminan Hak Tanggungan apabila debitor pailit. Jenis penelitian yang digunakan dalam penelitian ini adalah penelitian hukum normatif dan metode pendekatan dari penelitian ini adalah pendekatan undang-undang. Sumber dan jenis bahan hukumnya adalah peraturan perundang-undangan, literatur yang relevan dengan penelitian ini, tersier; KBBI dan kamus hukum. Teknik pengumpulan bahan hukum primer dilakukan dengan menggunakan metode inventarisasi dan kategorisasi undang-undang sesuai dengan hierarkinya. Teknik analisis dalam penelitian ini adalah menganalisa dan membuat kesimpulan dengan menggunakan dasar dari bahan-bahan ajar pustaka.
