URGENSI PERLINDUNGAN HUKUM TERHADAP ANAK KORBAN MATERI PELECEHAN SEKSUAL

Abstrak

The purpose of this study is to describe issues regarding relevance that have to do with the legal protection of children as victims of sexual abuse material. This research is normative juridical law research, so the approach used is statutory and conceptual. The results of this study found that there was a legal vacuum in the Child Protection Act, where there were no strict rules regarding children as victims of sexual abuse, which then resulted from this abuse being made material by the perpetrators and distributed to other parties. Sexual abuse material is an activity of possessing, sharing, or producing related material which can be in the form of unlimited photos or videos with sexual nuances, where the victims here are children. Especially if the sexual abuse material is shared by the perpetrator via the internet, where later it is not impossible if the material continues to be spread because it is supported by the current technological sophistication. Child victims of sexual abuse material will become victims repeatedly if their sexual abuse material is continuously shared by those who find the material. For this reason, the victim's child has the right to receive legal protection that has been stipulated in the existing regulations. Even so, child victims of sexual abuse material cannot be fulfilled optimally because there are no clear rules. Thus, strict legal regulations are needed to regulate the protection of child victims of sexual abuse material. Parents, family, community, and the state have an important position in achieving the desired child protection implementation. As it should be, children need to be cared for and protected by their rights as human beings whose dignity needs to be upheld. So that later the child is able to hold the responsibilities that will be faced in the future.
