HUKUM POSITIF DAN THE LIVING LAW (Eksistensi dan Keberlakuannya dalam Masyarakat)
Abstract
Sebagai produk budaya, hukum selalu eksis dalam setiap masyarakat. Karenanya, hukum yang tidak diciptakan, namun hukum ditemukan dalam masyarakat (the living law). Namun seiring lahirnya negara modern, the living law cenderung dihilangkan dan diganti dengan hukum positif (state law). Bahkan the living law tidak dianggap sebagai hukum. Namun demikian, dalam sistem hukum Indonesia the living law masih diakui dengan batas-batas tertentu, seperti pengakuan terhadap masyarakat adat dan hak-haknya tradisionalnya, pengakuan hak ulayat dan sebagainya.
